RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
GOLDIE PALOOZA™ 2024 RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT I, the participant, certify and assure that my Dog(s) is/are current with all vaccinations, including Rabies, is/are in good health, is/are able to tolerate the presence of crowds and other dogs, and has/have not in the past exhibited aggressive behavior toward persons or other dogs, nor caused injury to a person or another dog. I agree to abide by all the rules and instructions given in connection with the Goldie Palooza™. I agree to keep my dog(s) on a leash no longer than 6’ at all times while at Goldie Palooza™ and to be a responsible dog owner by picking up after my dog(s).
I understand there are certain risks to attending Goldie Palooza™ 2024 that Southern California Golden Retriever Rescue and its shareholders, directors, officers, employees, partners, affiliates, agents, and successors, as well as Goldie Palooza™ organizers, sponsors, vendors and volunteers (“Released Parties”) cannot eliminate by using reasonable care, including, among others, the risk of contracting illness, such as COVID-19, risk of harm or injury from other Goldie Palooza™ attendees and/or their dogs, risk of property damage, bodily injury, permanent disability and possible death. HAVING KNOWLEDGE OF THESE DANGERS, AND FULLY APPRECIATING THE RISKS INVOLVED, I, THE UNDERSIGNED, VOLUNTARILY TAKE RESPONSIBILITY FOR ALL RISKS OF ATTENDING GOLDIE PALOOZA™ 2024.
In exchange for being admitted to Goldie Palooza™, I, for myself and on behalf of my heirs, representatives and assigns, release and hold harmless the Released Parties from all legal and financial responsibility and agree not to sue for any harm or injury of any nature (including economic loss, illness, injury, disability, or death) that I, and any minor(s) accompanying me and listed below (“Accompanying Minor(s)”), my dog(s), or personal property might suffer during or as a result of our attendance at Goldie Palooza™, even if the harm is caused by the negligence of the Released Parties.
To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from (that is to say, I agree to pay or reimburse the Released Parties for) any claims, losses, damage, assessments, fines, expenses, costs, legal fees, and causes of action or penalties of any kind (“Costs”) that the Released Parties have to pay for any claim for loss or injury arising out of or resulting from the actions or omissions of me/Accompanying Minor(s)/my dog(s) at Goldie Palooza™; provided, however, that nothing in this Release shall be understood to provide for indemnity of the Released Parties for their sole gross negligence or willful misconduct.
I expressly consent to Goldie Palooza™, Southern California Golden Retriever Rescue, and its agents, using the name, picture, and likeness of me, Accompanying Minor(s), and/or my dog(s) as recorded by the Goldie Palooza™ on 04/07/2024 for the purpose of the Goldie Palooza™. I authorize the Goldie Palooza™ 2024, Southern California Golden Retriever Rescue and its agents, to use, reproduce, exhibit, or distribute the name and likeness of me, Accompanying Minor(s), and/or my dog(s) for the above purpose in any communications medium currently existing or later created, including, without limitation, print media, television, and social media platforms.
I, for myself and on behalf of my heirs, representatives and assigns, release and hold harmless the Released Parties, from liability for any appropriation of likeness or use of the name or likeness of me, Accompanying Minor(s), and/or my dog(s) for the purpose and communications media described above. I understand that all recordings of the name, picture, and likeness, in whatever medium, of me, Accompanying Minor(s), and/or my dog(s) shall remain the property of the Goldie Palooza™.
By signing this waiver, I expressly acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present. By attending Goldie Palooza™ 2024, I voluntarily assume all risks related to exposure to COVID-19 and agree not to hold Goldie Palooza™ or any of their affiliates, attendees, sponsors, vendors or volunteers liable for any death, illness or injury of me or my minor children, even if caused by the negligence of the Released Parties.
I UNDERSTAND THAT BY SIGNING THIS RELEASE I AM GIVING UP MY LEGAL RIGHT TO SUE THE RELEASED PARTIES AND/OR TO SEEK COMPENSATION FROM THE RELEASED PARTIES FOR ANY INJURIES OR DAMAGES THAT I, ACCOMPANYING MINOR(S), OR MY DOG(S) MAY INCUR AS A RESULT OF, OR INCIDENT TO, OR OTHERWISE IN CONNECTION WITH THE PARTICIPATION OF ME, ACCOMPANYING MINOR(S), OR MY DOG(S) IN THE GOLDIE PALOOZA™ OR ANY USE AND/OR PUBLICATION OF THE NAME, LIKENESS, IMAGE, VOICE, RECORDING, BIOGRAPHICAL INFORMATION, AND/OR OTHER IDENTIFICATION OF ME, ACCOMPANYING MINOR(S), OR MY DOG(S) BY ANY OR ALL THE RELEASED PARTIES.
I have read, understand and agree to all the terms in this Release and Waiver of Liability and Indemnity Agreement and am submitting this entry on my own behalf, on behalf of my guests and on behalf of the accompanying minor(s).
